No law suit for tree cutting

BUCKFIELD —  The town will probably not bring a civil suit against a resident who allegedly had 35 trees harvested on town property.

Town Manager Dana Lee told board members Tuesday, that Maine Forest Service Ranger Brad Bucknell investigated the cut along the town-owned railroad bed.

The resident's deed, however, allows improvements to the property in order to preserve the right of way and access to utilities, Lee said.

Lee said Bucknell was informed by the district attorney that the deed's wording allowed the case to be argued either way and, therefore, the DA would not prosecute it.

The town's other options were to pursue civil litigation or reach a private settlement with the landowner, Lee said, but although the town might recoup $2,000 from the trees, it was not enough, in Lee's opinion, to justify a civil suit.
